La Capsuleria Srl with registered office in Via Travagliato 28-Torbole Casaglia (BS), Tax Code and VAT no. 03861540981, Rea no. 569386, C.S. € 30,000 i.v., email: [email protected], makes available to customers who wish to take advantage of them, discounts, benefits and services at "La Capsuleria" shops (both direct, affiliated, and on the online shop adhering to the initiative). To take advantage of these benefits, it is necessary to register to the Loyalty Program of La Capsuleria. The use of the Loyalty Programme in general is governed by the following conditions (hereinafter also the "Rules"), which the "Recipient Customer" must read carefully. The activation of the loyalty programme in the manner set out in paragraph 6 below, implies the Customer's acceptance of these Rules.La Capsuleria Srl reserves the right to periodically change, even partially, these conditions, and the relevant changes will come into force after 10 (ten) consecutive days from their printing and publication in the La Capsuleria shops. In the event that the "Addressee Customer" does not accept the changes made, he/she will have the right to cancel his/her registration, a right which, in any case, he/she is entitled to at any time according to what is specified below.The use of the loyalty programme, after the entry into force of the changes, implies in any case the acceptance, by conclusive facts, of the changes made. Capsuleria Srl also reserves the right to suspend, temporarily or permanently, at any time, this loyalty program, without the Customer having any right to complain in this regard (subject only to respect for the rights already acquired by the participants at that time), by giving printed notice in the shops participating in the initiative.These Regulations are always available for consultation in each shop participating in the initiative.

2. PARTICIPANTS

All shops under the "La Capsuleria" brand name, whether they are directly managed by La Capsuleria Srl (so-called "direct shops"), or affiliated, or the online shop "www.lacapsuleria.com" and, therefore, managed by other company names (so-called "affiliated shops"), which adhere to the initiative by displaying the relevant advertising and information material. The Loyalty Programme is valid only and exclusively at the point of sale/online shop where the registration is made, subject to verbal or written agreements made with La Capsuleria Srl

4. GENERAL INFO

This is a promotional initiative consisting in a loyalty programme that consists in collecting points on a card/ or on the management of the physical or virtual shop of La Capsuleria and in recognising exclusive advantages to its holders. The aim of the initiative is to build Customer loyalty through a loyalty programme that grants advantages to Customers registered in the loyalty programme. Without prejudice to what is stated in the introduction, and in point 9 ("Interruption of the programme - Card deactivation - Miscellaneous"), the "Card" is not subject to expiry.

5. RECIPIENTS

End customers over 18 years of age enrolled in La Capsuleria's Loyalty Programme according to the registration and operating procedures set out below.

6. MODE OF REGISTRATION

Registration in La Capsuleria's Loyalty Programme and the issue of the corresponding physical/virtual Card will be issued to the Customer in paper/virtual format directly from the point of sale/online shop. The "blank" card delivered to the Customer can immediately be used by associating it with a possible purchase. Activation/registration takes place in compliance with privacy regulations. The Card of the La Capsuleria loyalty programme is personal and non-transferable. In the event of loss or theft of their Card, the customer must go to the specific La Capsuleria shop where they registered to ask for a replacement: once the customer's identification data have been verified, the lost/stolen Card will be cancelled and the customer will immediately receive a new one which will enable them to recover any points already accumulated and not used. The Customer may freely request to be cancelled from the loyalty programme at any time by contacting the specific La Capsuleria sales outlet where he/she registered.

7. ACQUISITION OF POINTS

Loyalty points will be automatically uploaded to the Loyalty Programme in the management system of the physical/virtual La Capsuleria shop of reference with every purchase in the La Capsuleria shop of reference. To the extent of one point per euro spent (e.g. € 1.99 = 1.99 point). In order to be entitled to the points, the Customer must identify him/herself before the receipt is issued by presenting his/her "Card" or by indicating his/her surname and first name or the e-mail address issued for the activation of the same / or by logging in to the virtual shop. Failure to identify the holder of the Card in the manner indicated above will not allow the loading of points, nor will the loading be possible at a later date.The customer may at any time know their accumulated points balance by requesting it in the reference La Capsuleria shop. The points will be loaded and accounted for by the system on a daily basis; in the event of unforeseen technical problems they may be loaded within a longer period, of a maximum of 15 days.Returns will generate the debiting of points according to the same criteria as the crediting.The issuance of "Gift Card" will generate the crediting of the relative points. Subsequent purchases paid partially/totally with Gift Card by the card holder will not generate any points credit for the part of the receipt value paid with Gift Card. The Card does not constitute in any way a payment card; the points accumulated on it cannot be transferred or converted into money or products.

8. ADVANTAGES

Customers enrolled in La Capsuleria's Loyalty programme will be able to benefit from numerous discounts, promotional operations, prize operations, and special dedicated initiatives, which will be adequately publicised and communicated from time to time.The customer will only be able to take advantage of the dedicated benefits upon presentation of his "Card" or the communication of his Name and Surname before the receipt is issued, after logging in to the virtual shop.

9. CARD INTERRUPTION/DEACTIVATION

La Capsuleria Srl reserves the right to modify, suspend or interrupt at any time and at its own discretion the Capsuleria loyalty programme and related services. Notice of such changes, suspensions or interruptions will be given by inserting a suitable notice in the relevant La Capsuleria shop or by email to the email address provided by the customer. Without prejudice to any other right provided by law, including the right to compensation for damages, La Capsuleria Srl may revoke the customer's right to use the Card and deactivate it in case of use of the Card in violation of the conditions set out in these Regulations or in case of abusive use or damage to the image and brand "La Capsuleria". In addition, subject to prior notice, La Capsuleria Srl reserves the right to deactivate the subscription to the loyalty program and the related activation/registration in case of non-use of the Card or inactivity of the Customer for a period exceeding 5 years. In case of revocation and deactivation, the Customer will no longer be able to enjoy the benefits and services related thereto. La Capsuleria Srl is not responsible for any consequences, direct or indirect, related to malfunctions of the loyalty program not dependent on its own will. Capsuleria Srl is not responsible for any fraudulent, improper or abusive use of the Card.

10. DURATION

this loyalty programme runs until 31 December 2024

11. UNUSED POINTS

All points not used by the customer by 31 December 2024 will be reset and cancelled
